In a first reading, the Portuguese Parliament has backed plans to reintroduce a mandatory medical opinion for any legal gender and name change \u2013 effectively undoing the 2018 reform that allowed people to change their legal gender based on self-declaration from the age of 16. Human rights groups warn this is not a \u201ctechnical adjustment\u201d, but a political rollback that targets trans and intersex communities.<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"682\" height=\"369\" src=\"https:\/\/ket.brussels\/wp-content\/uploads\/2026\/03\/Capture-decran-2026-03-26-101437.jpg\" alt=\"\" class=\"wp-image-51852\" srcset=\"https:\/\/ket.brussels\/wp-content\/uploads\/2026\/03\/Capture-decran-2026-03-26-101437.jpg 682w, https:\/\/ket.brussels\/wp-content\/uploads\/2026\/03\/Capture-decran-2026-03-26-101437-300x162.jpg 300w\" sizes=\"auto, (max-width: 682px) 100vw, 682px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The end of self-determination?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2018, Portugal made international headlines by adopting a law that allowed trans people to change their legal gender without a psychiatric diagnosis, starting at 16 with parental consent. This move was hailed by organisations like ILGA-Europe as a major step towards depathologising trans and intersex identities and aligning with human rights standards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new proposals adopted in first reading directly attack that core principle. Under the draft laws, anyone seeking to change their legal gender and name will once again need a prior medical opinion. In practice, this would:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>turn legal recognition back into a medicalised process,<\/li>\n\n\n\n<li>give health professionals gatekeeping power over people\u2019s identities,<\/li>\n\n\n\n<li>and risk creating new delays, extra costs and arbitrary refusals for trans and intersex people.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For communities who fought to get the 2018 law in place, this is seen as a clear backward step rather than a mere \u201cupdate\u201d of the system.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Who is pushing the rollback?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Three separate bills have been tabled and approved in first reading. They all come from the current right-wing and far-right majority:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the centre-right Social Democratic Party (PSD) of Prime Minister Lu\u00eds Montenegro,<\/li>\n\n\n\n<li>its conservative ally CDS-PP,<a href=\"https:\/\/www.robert-schuman.eu\/en\/monitor\/6520-the-social-democratic-party-of-outgoing-prime-minister-luis-montenegro-favourite-in-the-general-election-in-portugal-on-18-may\" target=\"_blank\" rel=\"noreferrer noopener\"><\/a>\u200b<\/li>\n\n\n\n<li>and the far-right party Chega, now the second-largest political force in the country.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">These texts will now be merged into a single bill before a final vote. During the debate, PSD MP Andreia Neto argued that \u201cdecisions of this nature should not be taken without the necessary clinical follow-up\u201d, framing the change as a matter of \u201cprotection\u201d and \u201cresponsibility\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Progressive MPs and activists see it very differently. Socialist MP Isabel Moreira called the texts \u201can attack on the health, dignity and freedom of trans and intersex people\u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pushback from NGOs and health professionals<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Civil society organisations and professional bodies have been quick to react.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Association for Family Planning (APF) warned against \u201ca political setback\u201d, stressing that trans and intersex people already face significant barriers in access to healthcare and legal recognition.<\/li>\n\n\n\n<li>The Portuguese Society of Clinical Sexology denounced the measure as \u201cscientifically unfounded\u201d and harmful to an already vulnerable population, pointing out that international standards increasingly support self-determination models.<\/li>\n\n\n\n<li>ILGA-Europe called on MPs to reject the bills, describing them as \u201cattacks on the rights of trans and intersex people\u201d and a departure from Portugal\u2019s previous leadership role on LGBTI+ equality.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In a statement, ILGA-Europe also situated what is happening in Lisbon within a broader European pattern: \u201cWhat is happening in Portugal does not come out of nowhere. Across Europe, we see some political parties increasingly targeting trans and intersex people, using similar tactics: invoking \u2018biological sex\u2019, \u2018family protection\u2019 and \u2018child protection\u2019 to justify rollbacks in rights.\u201d<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/www.iglyo.org\/news\/portugal-dont-roll-back-trans-and-intersex-rights\"><\/a>\u200b<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A new chapter in Europe\u2019s anti-trans politics<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Portuguese debate mirrors trends we\u2019ve been covering across the continent. In recent years, several European governments have:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>restricted or attempted to restrict access to transition-related care, especially for minors,<\/li>\n\n\n\n<li>tightened or blocked legal gender recognition procedures,<\/li>\n\n\n\n<li>refused to recognise non-binary identities in law, even when courts have urged reforms.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The messaging looks familiar:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>re-centring \u201cbiological sex\u201d as the only legitimate category,<\/li>\n\n\n\n<li>claiming to \u201cprotect children\u201d by questioning young people\u2019s ability to know their own gender,<\/li>\n\n\n\n<li>presenting trans people as a \u201cthreat\u201d to families, women\u2019s rights or social stability.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Portugal, which has consistently ranked high in ILGA-Europe\u2019s annual Rainbow Map of LGBTI+ rights, now risks sliding down the index if this reform is adopted. For many activists, this vote is seen as a test-case for how far the new right-wing and far-right majority is prepared to go in challenging LGBTI+ gains more broadly.<a rel=\"noreferrer noopener\" target=\"_blank\" href=\"https:\/\/www.ilga-europe.org\/files\/uploads\/2024\/02\/2024_portugal.pdf\"><\/a>\u200b<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>What happens next?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legislative process is not over yet:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the three bills will be consolidated into a single draft;<\/li>\n\n\n\n<li>that final text will go back to Parliament for a conclusive vote.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In the meantime, trans and intersex groups in Portugal \u2013 together with European networks \u2013 are ramping up their mobilisation. We can expect:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>public campaigns centring the voices and lived experiences of trans and intersex people,<\/li>\n\n\n\n<li>pressure on MPs from human rights organisations at national and EU level,<\/li>\n\n\n\n<li>renewed scrutiny of Portugal\u2019s human rights record in upcoming international reports.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">For trans and intersex people on the ground, the stakes are starkly concrete. Re-medicalising legal gender recognition means returning to a system where doctors, rather than individuals themselves, have the final say over IDs, documents and everyday safety.
